What is due, how late it is — and when to file on SAMADHAN

Enter your last working day, the day you sent the written demand and what the company still owes. You get the total, the legal due dates, the days overdue and the dates for the SAMADHAN claim and the letter to the labour authority, with both texts ready below.

  1. Send the written demand first if you have not (the previous step) and keep the proof of sending.
  2. Fifteen days without payment: file the claim on SAMADHAN with the text below, your appointment letter, salary slips, resignation acceptance and the demand.
  3. Still nothing: send the letter to your state Labour Commissioner or Inspector-cum-Facilitator; keep copies of everything.

Final wages: within two working days of removal, dismissal, retrenchment or resignation (Code on Wages, 2019, s. 17(2)), counted Monday–Friday, holidays not taken off. Gratuity: within 30 days from the date it becomes payable (Code on Social Security, 2020, s. 56). A claim to the authority: within three years from the date it arises (Code on Wages, s. 45(6)). The Labour Codes are in force from 21 November 2025. The 15 and 30 days before SAMADHAN and the letter are our planning steps, not legal terms.

If nothing comes, file the claim on SAMADHAN (samadhan.labour.gov.in or UMANG).

  4. 4

    Attach your papers

  5. 5

    Write to the authority
