How to work abroad without an agency — the law, the employer’s documents, and the money before you fly

Short answer. A job offer from an employer abroad, no agency? Ban on direct hiring: No employer may directly hire a Filipino worker for overseas employment unless exempted by law or by a DMW issuance (DMW Department Circular No. 01, s. 2023, Sec. 126; Labor Code, Art. 18).

  • Ask your employer for the documents — a planning suggestion, about 3 months before: type the date
  • Check the current direct-hire list and fees with the DMW — a planning suggestion: type the date

Check your own case.

These are planning suggestions, not legal deadlines. The DMW sets the steps and the processing time — check them before you start.

Before you fly

What you need before you fly — and how much to save each month

Pick where you are going and the prices fill in as an example — put in your own. You get the total and a monthly amount to put aside until your departure date.

  1. Send the letter below to your employer: it asks for the contract and the documents for your direct hire.
  2. Check the current direct-hire list and fees with the DMW or the Migrant Workers Office covering your country.
  3. Save the monthly amount — the ipon challenge splits it into weeks. Book the flight only after the DMW processing is done.

Prices are examples, not averages — put in your own quotes. The law: Labor Code, Art. 18 (as amended by P.D. 1412) bans direct hiring of Filipino workers for overseas employment, except by members of the diplomatic service, officials and employees of international organizations and such other employers as may be allowed. The current DMW documents, fees and steps are not reproduced here — check them at dmw.gov.ph.

Fees: the only published table is in the DMW FAQ of 2022 (OEC processing fee US$100, OWWA US$25, Pag-IBIG ₱100 a month, PhilHealth ₱2,400) — older than the current rules, so confirm the amounts with the DMW before you pay.

Step by step

What to do, in order

  1. 1

    Ask the employer

Is the employer in an exempt category (diplomatic, international organization, relative) — or will it use its one-time professional / skilled exemption (up to 5 workers)? The letter below asks for the contract and documents.

  2. 2

    Get the contract verified

The Migrant Workers Office in that country verifies the contract (or the Philippine embassy authenticates it).

  3. 3

    e-Registration and POPS-Direct

Register online, upload documents for Phase 1 (clearance). The evaluator answers in 7 working days.

  4. 4

    Phase 2

Medical exam at a DOH-accredited clinic, PEOS and PDOS, insurance; upload, then pick your OEC release date.

  5. 5

    Count and save

The calculator shows the money to have before you fly; the ipon challenge splits it into weeks.

  6. 6

    Book the flight last

Only after the OEC is issued. Never pay a Facebook «helper» for an exemption.

Questions

Can I work abroad without an agency?

Only if your employer is exempt from the ban on direct hiring (DC 01-2023, Sec. 126): diplomatic corps, international organizations, high officials, a relative living there, or an employer using its one-time exemption for up to 5 professional or skilled workers. Otherwise the DMW sends you to a licensed agency.

Do I pay someone to process my direct hire?

No. You apply yourself through e-Registration and POPS-Direct. The DMW warns that Facebook groups charging for «help» are not authorized (Advisory 20-2023).

Should I buy the plane ticket first?

No. The DMW says to book only after the OEC is issued.
