Your holiday pay when you leave — unused weeks, the 8% and what was already paid
Put in your gross earnings since your last anniversary, the weeks of holidays you are owed, your ordinary weekly pay and your last 12 months of gross pay. You get each part of the holiday pay that belongs in your final pay, a worksheet and a letter asking your employer for the breakdown. No sign-up.
- Compare the total with the holiday pay on your final payslip — the Excel file has a «Payslip check» sheet.
- If it does not match, send the letter asking for the breakdown: weeks, ordinary weekly pay, average weekly earnings and the gross the 8% was applied to.
- Still stuck? Employment New Zealand: 0800 20 90 20. Final holiday pay is due on or before the payday of the final pay period.
Arithmetic only, as Employment New Zealand explains the Holidays Act 2003: unused weeks × the greater of ordinary weekly pay and average weekly earnings, plus 8% of gross earnings since your last anniversary (the gross includes the holidays paid out), less holidays taken in advance or paid as you go. Public holidays after your last day and your employment agreement can change the result. Not legal advice. The Employment Leave Act replaces these rules from 6 August 2028.

Questions
How is holiday pay calculated when you leave a job in NZ?
Unused annual holidays you are entitled to are paid at the greater of your ordinary weekly pay and your average weekly earnings for the last 12 months. For the time since your last anniversary you also get at least 8% of gross earnings — that gross includes the holidays paid out — less holidays taken in advance or paid as you go.
I worked less than 12 months — what do I get?
8% of your gross earnings since you started, less any holiday pay already paid (holidays taken in advance or 8% pay-as-you-go).
Is 8% holiday pay for casual workers the same thing?
Pay-as-you-go 8% can only be agreed if you are on a fixed-term agreement under 12 months or work so irregularly that 4 weeks of holidays are impractical. If you were paid 8% with each pay, put it in «already paid» so it is not counted twice.
When must my employer pay it?
Employment NZ: the final leave and holiday payment must be paid on or before the payday of the final pay period.
Does the new Employment Leave Act change this?
Not yet. Employment NZ says the Employment Leave Act replaces the Holidays Act on 6 August 2028; until then the Holidays Act rules apply.
