  • Employer's 15 days to decide in writing — counted from the day the employer RECEIVES your notice. Enter the delivery date to see the real date: type the date
  • Last day to take the matter to the NIRC — 60 days after the employer's decision or after its 15 days run out. Enter that date to see the deadline: type the date

Check your own case.

Only the first date is counted from the termination: section 33(1) gives 90 days from the day the cause of grievance arises. The employer's 15 days run from the day your notice is brought to its notice (section 33(2)); the 60 days run from the employer's written decision or from the end of those 15 days (proviso to section 33(4)). Run the calculator again with those dates.

    Note the key date

The date on your termination letter, or the day you were stopped from coming to work.

  2. 2

    Count the 90 days

Enter that date: you will see the last day your notice must reach the employer.

  3. 3

    Fill in the notice

Joining date, post, wages, what happened, why it is unfair, and the dues you are owed.

  4. 4

    Send it with proof

By registered post A.D. or courier, with a copy by e-mail. Keep the receipt and tracking.

  5. 5

    Wait 15 days

Counted from the day the employer receives your notice. Keep any written reply.

  6. 6

Go to the NIRC in time

If there is no decision or you are not satisfied, file the grievance petition within 60 days.

Questions

Can I go straight to the NIRC without a notice?

No. Section 33 sets the order: first a written grievance notice to the employer, then — if there is no decision in 15 days or you are not satisfied — the Commission. Send the notice first and keep proof of delivery.

I was a manager. Does section 33 apply to me?

The Act covers 'workers'. Persons employed mainly in a managerial or administrative capacity are excluded. Job titles do not decide this — the actual nature of your work does.

Will this get me reinstated?

No one can promise that. The notice keeps your right to go to the Commission, puts your case on record and asks the employer for a written decision within 15 days.
