Questions
What is a durable power of attorney?
One that keeps working if you become unable to manage your affairs. This form says so in Part 3.
Does a power of attorney need to be notarized?
Many states require it, and banks usually expect it. Under the Uniform Act a notarized signature is presumed genuine.
Is this a medical power of attorney?
No. Health-care decisions need a separate health care power of attorney or advance directive under your state’s law.
Can my agent make gifts or change beneficiaries?
Only if you initial those powers in Part 6, and within the limits you write there.
How do I cancel a power of attorney?
Sign the revocation page and send copies to your agent and everyone who has the power of attorney.
How do I send it to the bank and the agent?
Send the signed copy from Layers with tracking — you see who opened it — and keep a record of exactly what was sent.
