If you say your termination was unfair, the dispute goes to the Commission for Mediation and Arbitration (CMA) on form CMA F.1 within 30 days of being terminated. Other labour disputes have 60 days from the day they arose. You give the other side a copy by hand, fax or registered mail, and attach proof of that when you file. After the 30 days, you apply for condonation with form CMA F.2, a notice of application and an affidavit. The draft sheet below is for preparing: it is not the CMA's own form.

Questions

How do I fill in CMA form no 1?

Use the current form from the CMA. Our sheet collects what you are likely to need first: both parties, the dates, the kind of dispute and what you ask for. Before you sign, ask the CMA office to check that you have chosen the right parts of the form.

Where can I get CMA form no 1 as a PDF?

We did not find the form on the CMA's list of laws and rules. Ask a CMA office for the current version. That also tells you the form is the one in use today.

When do my 30 days start if I appealed inside the company?

The High Court describes the rule like this: from the date of termination, or from the date the employer made a final decision to terminate or to uphold the decision. Keep the letter that shows that date.

What if more than 30 days have passed?

The CMA says to apply for condonation with form CMA F.2, a notice of application and an affidavit. The sheet has a section for the dates and your reasons. Whether to allow it is for the CMA.

Must I tell my employer before I file?

The completed form must be sent to the other party, and you attach proof of that when you file. The proof page in the sheet is for this.

Where do I file?

Ask the nearest CMA office. The CMA's head office is at PSSSF Building, 6th floor, Makole Road, Dodoma, P.O. Box 716, email dir@cma.go.tz.
