Questions
What is the notice period for resigning in Romania?
The one in your individual or applicable collective employment contract, but no more than 20 working days for non-management roles and 45 working days for management roles (Labour Code, Art. 81(4)).
Is the notice in working days or calendar days?
The legal maximum is in working days: weekends and public holidays do not count. Example: letter registered on Monday 26 October 2026 with 20 working days — the last day is 23 November 2026.
Can I write my resignation in English?
The Labour Code does not set a language for the resignation, but many employers register only a Romanian text. The document includes the same letter in Romanian, ready to sign.
Can I leave without working my notice?
Yes, if the employer agrees to waive it (Art. 81(7)) or if it is in breach of the contract (Art. 81(8)). During probation, a simple written notification ends the contract with no notice (Art. 31(3)).
What happens to my untaken holiday?
Untaken annual leave is paid in money when the contract ends (Art. 146(3)). The Excel estimates it from the daily average of the last 3 months (Art. 150(2)).
